The person who is doing this did ask me first. I'm sorry I did not make this clear.
I honestly didn't think it would actually happen until he approached the owner. People say things all the time to me that I don't take seriously. That is why I didn't even say anything about the correct way to record. I actually have the capability to record from my system ,but don't want the headache of it. Now I just want to be left out of it as much as possible. If they want to mic the speakers, fine, but don't touch my equipment. If they want to hand pick the singers, fine, but I will not be doing the picking. People already don't like the owner, so if it goes bad they can blame him.
The guy who is doing this is a very nice business man in his 50s. I have never had a problem with him personally. That is the only thing that makes me feel better about the situation.
If someone is upset they are not on the cd I will offer my spot. This whole thing rubs me wrong.
I have had a lot of problems with this venue, but I am not willing to give up the money. I would love to have the balls to walk up to the owner and give him a piece of my mind. Someday this will happen. I have stuck to my guns about the important things and let the little things slide. My most important priority is protecting my equipment and myself.
You all have been a great support to me. Your opinions I value highly. Thank you!

Oh I do! There are certain things I won't tollerate from anyone. I'm not a total push over.
I have made a lot of changes with everyones help here and things are better.

Is my reading comprehension bad, or is this your first mention of "Cutting this on CD" ? Your spot meaning you already know you are one of the singers who will be on a CD ? Not only are you a singer, but you are THE entertainment providing ALL the aspects of others backing music too ? You might be being used Bab's ! Perhaps set-up. They have YOU singing on a CD are recording YOUR venue, and you have no idea what the plans are. How do you know they aren't going to reproduce this for personal gain ? Who knows, They can now say you requested this to be recorded...You are singing on a CD, and providing the entertainment after-all Would you be providing the music to a duplicated CD that these people might intend on using for some aspect of promotion, or income ? This changes the dynamics I believe... I assumed they were just taping singers to possibly make a decision on who will win their contest ? Now not only are they controlling your rotation, but it's getting a bit more "hairy" than you originally mentioned... YOU are the provider of others music that they are copying to CD, and planning to distribute ? and they will say they have your expressed permission ? Although I'm not in the recording aspect of the music business, you can be certain that the ONLY conditions I'd knowingly allow my bands (in the past) to go onto an album was if *I* (assuming I had control, usually I didn't (LOL) because I was part of an organisation that had a manager and other members too) had complete say of the recording, and there was some contract in writing agreed on. Yet YOU are the sole music provider Babs, what are they doing with this "CD" or "CD's" for all you know ? They are digitally recording work by mic'ing the speakers and not going direct ??? (ROFLAO) Bab's sorry, but I'm seeing some red flags here... I wasn't aware about "CD" until your last post.... Quote: The guy who is doing this is a very nice business man in his 50s. Bab's, Give your atty a quick call. Get some sort've idea as to how you clear yourself assuming they are cutting a CD where you are providing other's music.
God only know's who this can come back on...
Lovely how they want to record your show, yet an owner noone likes, and a well-kempt businessman you haven't a clue about, and YOU.... are all a part of the result.. and who's butt will this fall on if the CD becomes published and a source of revenue ? Will they say
"Well the entertainment provider gave her expressed consent, and we were riding on her license to provide music to be recorded ? Oooops. Heck, she was the one who originally OK'd us recording her show, we weren't meaning to pirate anything"
Like I mentioned, I'm not in the recording area, but I was (and am a now semi-retired) business man in a somewhat related area...Call your atty, and make sure they aren't riding on YOUR license to provide music on what might be a duplicated CD. You'd make a sweet innocent "fall guy" Bab's.. Sorry, but I don't blame you for feeling uneasy about this ! It's VERY shady. You know the absolute minimum they have to tell you, and this makes it convenient for this "nice businessman" :(

In many ways I have been involved in providing services for bars from sound systems to dart boards and leagues and all others. . We had a jukebox 3 dart boards and pool tables sitting in a bar for months because the bar was closed down locked up by the DEA. In a situation that might develop into grudges and perhaps ratting and legal battles I would circle the wagons. Believe me Babs I have been there. I dont want to alarm you but it is time to get better legal advise than you can from rumors and such..

I've been following this thread and now I have something to say. If they are recording CD's of the individual to take home as a souvenior I wouldn't be real concerned. However, if they are putting together an "album" I would have a great concern and would go back to the bar owner and let him know you are not comfortable with it. Either way I would definately let the owner know that you will not allow anyone to touch your equipment in any way.
If there is not anyway for you to get out of this and keep the gig too, I would make sure your name or company name is not associated with this at all.

Bab's, Is your equipment at home ? or do you leave it at the bar... If it's at home...Here's an easy solution...
CALL IN SICK that night ! Let them do ALL of this without you having ANY part of it. or as Karyoker said, call your Atty. You are a business, you have certain responsibilities... This is CERTAINLY a case where your atty should be contacted.. Not us.. Although this type situation is always a great heads up for others as to how what appears to be a "little thing", MIGHT escalate into a full blown piracy case.

If she wants to be a better person, she should get out've that repeatedly ugly venue, she's dealing with a boss that isn't a decent person, and she's made that clear.. She also can't stand up to this guy, she's made that clear too based on past events.. She's afraid of getting fired..
She's there for the money. If being a "decent person" were the issue, she'd be in a more reasonable environment.
So in her case, it's not a messed up suggestion at all, it has NOTHING to do with her being a better or worse character. She's decided she doesn't want to risk getting fired. This way she would be no part of confrontation that can get her into trouble, or backfire, If talking to this boss or these guys WERE an option, why hasn't she already done-so ? Because she's made it clear her boss is NOT an approachable person, yet she still opts to stay there. We aren't talking about ethics here. We are talking about her taking care of her. If she's to do the right thing it will likely mean confrontation.. For both you and I, that's no problem, for Bab's it is.
What recourse does she have ? She's given every indication thus-far that she's subservient to both a boss and venue that has repeatedly stepped on her. Eventually she'll have to stand up to this boss, which WILL likely mean the end of her job. Yet she's made it clear she isn't ready to risk losing this job. What good would discussing this with him be anyway ? He's not reasonable, she's stated this, he pulled her saturday gig from her after she showed up for it favoring live entertainment without regard for her as a business person, or person. Assuming he knows anything, (and it's still HER business permit and license we are talking about as music provider) HE will likely not discuss, or even know the details of this event. I assume he'll just say "I already told them yes, they could do it"... and she'll be the heavy either way...
What's the option for a person such as Bab's in a case like this ? She wants that job, doesn't want confrontation. For someone like her, this is NOT a bad suggestion, assuming they can't use her equipment either. She's REMOVING herself entirely from the situation and taking a path of least resistance. Should she tell her boss she'll have NOTHING to do with any of this ? OF COURSE SHE SHOULD... Yet she's not telling him, she's here telling us....
What you and I could do, is not always what I'd say is easiest or best for another more passive individual who won't take risks. She should quit that damn job altogether, yet that's also her choice not to do-so. I might do the ethical thing, others just need to get by !
She should have been looking for other work ALL along.. These difficult events aren't new for her.

Steven, I did not expect you of all people to tell someone to blatantly lie, about health of all things. I am disappointed in your advise.

I can stand up to the best of them...But I would actually be leaning towards having an illness that evening or a family issue...Just avoiding the situation could work well. But if she is not there with the main equipment they need to make this happen then they will prolly just reschedule. It just really looks like a no win situation.

Income that one night. Yep. It's a trade-off.
What do you suggest she do given what we do know about Bab's, and what she's indicated about that venue ? To say "quit" is moot. She's not willing to give that up entirely. What is a more feasible solution for the NON-confrontational person who is NOT willing to quit ?
Show up that night, and risk being a part of something she now has no control of ? Something that does however involve her ? Sure she should stand up for herself..
What do you think a more doable situation is for a person like Bab's ? I'm not telling you what I would do... I'd have quit. I stated this several events ago. I'm not Bab's.
It's wednesday already, and we are talking about the weekend.. Is she prepared to be willing to walk when she's told "this is a done deal" ? I think not.. Even assuming she speaks to these people tomorrow, you think she'd stand a chance at calling in sick a day later ? LOL
What do you propose Bab's do. That would be somewhat comfortable for her ? Assuming she can't handle confrontation ? Suggestions ?
Besides the obvious, FIND ANOTHER JOB.

Rescheduling gives her more time. She must tell her atty all she's told us about that place, and this event. She also will be better prepared to talk to those involved with legal backing or support..
Let her atty tell her what she should, and should not avoid.. She's now pressed for time, unfortuneately she's tacitly allowed this to go on this-far by saying yes to the "businessman", and he got clearance from her boss for this weekend.. Sometimes, and in certain cases there's no time like procrastination... She really should quit.... Easiest way out, devote a good few days to job hunting...

Again as I said, working in such a hell hole would not make me "comfortable" period, I'd have quit. I've advised Bab's to do-so several times.. She's still there.
This is a suggestion for Bab's... Not what I'd do... I can't keep telling her to quit, yet "Suck it up" ? She should sing, and allow a CD possibly duplicated of HER entertainment ? I think not.
I'm not trying to debate "doing the right thing", I'm suggesting she not take part until she's spoken with her atty, and gotten actual legal advice on how to handle HER OWN situation. She aleady made a mistake when she said "I don't care". Now she must get out've that as well..

Since I understand who you are, I understand where you are coming from. What else can BAB's do ? Remember, I wouldn't lie.. I'm trying to protect her SOMEHOW from doing something that will have ramifications.... In this case, what else can she do if she IS NOT willing to quit the job yet. In staying at that place of work, she's almost created a tangled web type scenerio for herself.
My actual advice to her HAS BEEN, stand up to this guy, or walk. She isn't willing to do-so, so I'm attempting to bide her time doing something she'd feel less uncomfortable doing.. I'm not playing shrink here, I'm proposing doable situations FOR HER, not me.. She show's up, she's singing on a recording, and providing the music for something she hasn't a clue about... If she asks last minute, still, how can she say no when she's consented ?
What is a better option for HER ?? right now ? Grab the bull by the horns ? I agree.
She must be willing to walk, or hear "We won't be employing you anymore" if she's to be assertive.. I would hope she could be.

Bab's, based on this discussion so-far. Can you take a risk, and be direct with your concerns ? Go in and speak to your boss ASAP ? Have a brief consultation with your atty first ? Like REALLY SOON ?
Is this boss the bar owner ? or a manager hired by the chains owner who few like ?
I'm confusing this a little with Topher's situation when the new manager dis'd him, and was nasty...
If he's the owner, I think he'll respect genuine concerns about possible legal wrongdoing which is why your atty would be a great first source. If he's just managing you MUST tell him about your stance as a subcontracted entertainment source, and how what you don't know can lead to potential probs, since he wouldn't have a clue, but would need to respect facts..
It's all in your presentation. So ShyGuy is once again correct
You should be coaxed into doing the right thing, no matter how tough it is for you. and not steared into a path of lesser resistance.
