8) Just how is that recouping coming along Lonman? When we talk about what they stole from them what are we talking about? The amount of the damages, is the fair retail value of the product in question. Minus any legal fees, is that why SC lately has been going easy on filing new suits? It just isn't worth it to file the suits, unless of course the can pressure errant hosts into licensing the unsold SC inventory. What is SC waiting for if everything is working so well? In 5 years they have filed around 1,000 suits many of which were dropped. Were even they resumed? In that time less than 2% of the problem has been addressed. In fact there are more pirates operating today than when this legal solution was started. At the current rate most of us will be dead and gone, before they recoup, that is if SC isn't out of business before that time.

8) The one who is lathered up is the one filing the suit tim. They are the one's who are maintaining they are the injured party and are demanding compensation. They are the ones jumping up and down and saying they got the fuzzy end of the sucker. I didn't use the product since I didn't need it to be successful. I'm done with my turn in the karaoke trenches. I just don't happen to have a love affair with companies or corporations, they make mistakes just like people which is ok with me since they want to be treated just like people. Even though they are really just legal fictions.

LR , let me ask you this: if you were to create a product and it's a recording with graphics that includes your trademark in it and it was originally made on disc. You sell a few and then you can't get rid of the remainder of discs because someone who bought the product and started distributed it for his own profit or worse is giving it away for free. Wouldn't you go sue their butt and anyone else who he gave it to? That is what SC is doing.

8) The first thing I would ask myself Danny is if I'm really wanting to do this in the first place, as far a the suing goes? Have I made a lot of bad business choices, that have led me to the point where I have to sue? Do I have the resources to effectively carry out this legal process to a successful conclusion? If I start suing who do I sue? Do I go after the home users abusers where most of the theft has occurred? Do I go after the HD providers who make wide scale piracy possible? Do I concentrate on the KJ hosts and entertainment service companies, because they are high profile and easier prey?

To me it makes no sense to enter into a process that is supposed to recover money, and costs more than what is recovered. At some point you have to look at some type of a risk reward ratio, concerning this whole legal process. Why is it that only SC of all the labels has decided to go this route? Are the other manus better equipped to met the changing times? Did they realize that maybe the profit margin just wasn't there for karaoke anymore, at least in the U.S.? I will say one thing SC is trying to change, it is at least considering downloads. Maybe at sometime they will join Cloud. They are starting to realize they need to change. The problem is it maybe too late. There is another way they can recover money Danny, they can take the final step all other now defunct karaoke manus have taken. Just dump whatever product they still have in inventory on the market and call it a day.

I can say that I would do just that...however SC is not. They are going after everyone BUT the ones doing what you have described. Suing someone like you, Chris, Lon, or anyone else who did not ask permission and not the hundreds and hundreds selling drives online (the people you mentioned in your scenario who have actually stolen from SC) is easier I guess.
but if it was done the way you describe, I would agree with you 100%.

Again, I don't really care anymore. If they sue someone that stole from them - great. If they win - great. If they lose - oh well. I frankly don't care. It's boring watching the same posts from the same people saying the same thing especially from those no longer in the game.
If they resume production - great, if not - oh well. I will buy from them again if I need the songs, if not, then I won't.

I was never sued.

i know, my point was that people like you and Chris who have done nothing but copy discs to drive and paid for every one are being sued and hunted (and remember...you paid) but the ones Danny was talking about are still going. Want every song under the sun including SC...just pay KJ Bill. that was my point, i'm sorry if i did not put it right. i did not mean to imply anything on you Lon.

the reason they implemented their policy on media shifting was due to piracy and unless you can come up with a way other than sift the media shifter from the pirates then they are going about it in the only way they can. Tell me is the general kj going to answer the request to see their discs if even asked politely. Judging by statements made here I would say no. So that leaves SC with only two options: sue them to make them comply or allow the pirates to win. You can't spot the pirate from a mile away like you use to by the discs they are using.

None of that prevents a legal Host from being named. I ran a few shows where I didn't have my books or kiosk available to me. Doesn't make me a pirate.
