The "DECISION" to settle was made over a month ago. When Sound Choice has a good day in court, the cheerleaders can't post about it quickly enough. When Kurt has to shell out $375,000, these same people are as quiet as a bunch of church mice.

$375,000 is one hell of a (@$%&#!) "Slep" but leave it up to a lawyer to paint it as an agreement and not a loss.

I don't think it is any secret that this was covered by insurance. Kurt didn't have to "shell out" anything, so if that's your criterion, yes, it was an agreement, not a loss.

8) Which brings up one of the questions I was wondering Jim, KTS was forced by it's insurance company to settle with EMI. Did Kurt's insurance company force him to settle with CAVS? You said the settlement was voluntary, did you want to continue to fight the case, or did the insurance company pull the plug to limit liability? Also with all this money the insurance company is paying out, I would imagine with EMI looming your premiums will be going up, maybe your policy being cancelled altogether.

LR, I'm not sure what detail you are looking for but the contention was phrasing by SC as they had said in their e-mail "illegal CAV machines". Had they said "CAV machine containing illegal SC material", they would have been safe. This is why one must be careful when writing. A dropped word, failure of clarification, etc can cause trouble for you whether you intended or not.

8) Well tim if someone posts a statement without anything to back it up generally most of the hosts would like to know what the source of the information is. I think that little detail might be of some use.

8) So does that mean Lon SC is currently marred with you? It would seem that SC isn't really having to much luck in the courtroom these days. They keep losing and there is still EMI to go, even if they win that one it isn't sure they are going to get permission afterwards to be making new product. Once their supply of current license material is exhausted what then? I know technically Jim is going to say that this last settlement wasn't a loss. Yet SC counts all settlements with hosts as wins? I guess it is just how you spin it, right?

Yes timberlea, the wording could have been different which would have avoided the issue.

I'm not sure, but I believe Steve Brophy was the one who wrote, & sent, that email originally.

Again, I am not sure, but I recollect that he was involved.

On another note, my opinion is that CAVS machines suck!

8) Poor Steve and Donna they are going to get the blame for all of SC's problems aren't they Insane? It would seem to me before any thing in print was sent out it should have been checked by the legal department aka Jim. If it wasn't wouldn't that mean Jim kinda let the team down and wasn't doing his job. He was probably too busy shaking the mom and and pop hosts down, to pay proper attention to his main job.

P.S. You shouldn't bad mouth CAVS Insane they might sue you, after all they won against CB and now SC, if you are going to count a settlement as a win. After all that is what SC does. The host is a pirate because he settled will the same be said of SC if they settle with EMI?

One big one down ( and I mean WAY down from 15+ million) and one to go.

Just a matter of finding out if EMI is in a "settling mood" or a "make an example" mood. I know that they have been in litigation with SC before, but things can change, especially with little birds whispering in EMI's ear about policy changes.

Let's see what happens...

8) You have to remember Joe CAVS won an award from CB that they never got paid, due to CB going into foreclosure. This time around CAVS probably felt $375,000.00 in the hand was worth 15 million in the bush. Which probably would have finished SC and they again would end up with nothing.

P.S. I think Kurt should look into hiring CAV's lawyers since they seem to be winning. Maybe they just have more winnable cases.

I would say Lon was marred by CAVs because of the poor quality. The machines I've seen were slow loading, graphics were broken up, not really good. Sort of like the quality of VocoPro.

I believe this is the document that APS & Associates / Steve Brophy distributed.

http://www.pdf-archive.com/2013/09/18/t ... stigation/

It seems you are trying to make it look like Sound Choice was simply a victim of APS & Associates and their wild west ways.

Your assumption is incorrect.

I have posted many times that it was a HUGE mistake for SC to have hired Brophy / APS and that SC ultimately is responsible.

However, if SC can ever catch up to Brophy, who apparently is on the LAM, perhaps they may be able to recover the loss.

I do see however, that the $325K was paid through insurance. Maybe the insurance company will have go after Brophy as well.

8) You mean 375 K don't you Insane? It is real nice to have one person to lay all of SC's troubles on isn't it. It is true what they say in the German Army "Victory has 100 fathers but defeat is an orphan". At one time you guys were one big happy family and now when the rubber meets the road, you all turn on each other.

Nope, the product I have is still useable and mostly the best renditions.

I agree the OLDER JB-99 CAVS machines were slow loading and the swipes sucked.

THEN they came out with the BETTER 199s that, when music was ripped in at least 192, WAS W-A-Y BETTER!!

The PROBLEM most kjs had/have is , (kinda like BOSE), they are a lot more EXPENSIVE than putting a laptop system together that has infinitely more bells & whistles.

...And bad experiences seeing the ones improperly put together... like bose systems too.

And YES the jb 199s that are still used in Vegas still SUCK. Music ripped in at the lowest possible bit rate and an inferior sound card. CAVS basically, DUH, IS a computer and MORE reliable than a laptop. Essentially the same as a desktop IMO.

I've had more problems with my laptop system than with my old 199. It never crapped out on me or overheated :)

Who cares? If one didn't like the CAVS product in the first place, what does anything else matter about it? Your question to Lon is a moot point.

Now that's funny! When you buy ANY product, be it a dishwasher, breakfast cereal or snow tires, do you check on the company financials first? Do you investigate their CEO for possible wrong doing? Do you wade into PACER to see how many lawsuits they have before buying those Lucky Charms?

Maybe you do, but the rest of the world doesnt. I use SC because they have the undisputed best base set in the business. "All the rest" as you say had nothing to do with my choosing awesome music for my fans.

8) I don't think so, one can dislike the CAVS product, one can like the SC product, but not like other aspects of their business model cue.

8) Only in your opinion Bazz I would match any of my zoom material against anything SC puts out, and it's newer. SC hasn't made anything for going on 5 years now.

Yeah. I'm the only one who thinks Sound Choice is the gold standard of Karaoke music.

I guess you don't understand what "Base Set" means. Since reading isn't one of your strong points, let me try to explain. I'll type real slow.

It means the CORE. The MEAT of the music we all play. The Elvis songs. The Beatles songs. The Rolling Stones songs. THAT is what "Base Set" means you see. Of which, hands down, Sound Choice is THE best in the business. Before GEM what were new KJ's told? Go buy a set of Sound Choice Foundations and if you have some left over, get the Bricks. THAT was the original Gold Standard Base Set.
