RaokeBoy wrote: Jimbo, so that fat judgment for $26,000 was far less than SC asserted for counterfeiting. Wow, that is about $8K for the contingency lawyer's portion after trial, assuming it is collectible and there is no appeal. First, how can one counterfeit something it didn't sell? Second, how can one counterfeit where the act alleged was for copying to a hard drive, neither a service nor a product covered by the class of goods of marks SC alleged were infringed? Third, you have never disputed that an award of full retail was excessive since the statute allows for "lost profits" and where Kurt testified at deposition, did he not, that lost profit per disc was merely $6-$7. So where is the grand string of SC successes at trial, let alone the chest pounder you tout above that are not subject to drastic reductions (they call it remittitur ) or being overturned on appeal? Let's be real. Being forced to trial has been disastrous for SC. If the cases were legitimate, it would make economic sense that it is settlements you're after. Except that Judge Wright nailed it, he found Slep-tone to be a vexatious troll. "The Court is convinced that this was nothing more than a shakedown suit." It seems that Slep-tone appeals most adverse rulings, but did not appeal this one. It must have agreed. The fact still remains - Far more cases have been resolved (by orders magnitude I should add) in favor of Sound Choice than against. All you have to hold up are a handful of the hundreds of cases. I don't blame you. If I was stranded in the middle of an ocean, I would try to flag down any vessel that goes by. No need to be choosy. Grab on to the first life preserver that get tossed and hold on for dear life. -Chris

The Lone Ranger wrote: 8) Come on Chris the majority of the settled cases you and I both know were out of court settlements, the details of which will never be known since both sides have to stay silent. If the hosts would have known that the suits were brought on questionable legal grounds, how many would have settled then? It would seem the best way to deal with this is not to settle with SC and let it go to trial, then see if SC follows through, drags out the process, or simply drops the whole matter. The reason both sides can hold up so few cases is the fact that not many went to trial in the first place. The few trials that have gone all the way at least recently have gone against SC. I can hardly wait to see what happens when equals duke it out. When CAVS and EMI cases are resolved and disclosed, will SC still be standing? It is you opinion that - "If the hosts would have known that the suits were brought on questionable legal grounds, how many would have settled then? It would seem the best way to deal with this is not to settle with SC and let it go to trial, then see if SC follows through, drags out the process, or simply drops the whole matter."It is my opinion that - For most hosts out there, they should follow the policies set forth by SC. If they have questions, contact an IP attorney. Finally, if they are sued, they should also contact an attorney. If you can't afford an attorney, then settle. The people I know that have settled say it is the next thing they have done for their respective karaoke businesses. We differ on opinions. I am not going to try to change your mind and I suggest you not waste your time trying to change mine. -Chris

But there are no Keystone Karaoke Kops questioning me. Just a bunch of Pom Pom Cheerleaders....and all of you are really all just crying the same thing. ' IT'S NOT FAIR".
NEWSFLASH!!!! LIFE IS NOT FAIR. You guys lose on this issue. Look at the percentages. The pirates have won, by a landslide.
The war is over. Sorry for your loss.

They probably bust the criminals selling them though, especially if they are touting them as real Rolex's. Should hosts be busted for having fake SC material, shouldn't the sellers of the hard drives be busted, they are the real offenders, aren't they?

Who said fake. What do you think happens to stolen goods? They are sold at a fraction of the price. When someone is caught with stolen goods (whether they stole them, bought them, or given them), will get charged for being in possession of stolen goods.

My priest seems to be okay with me getting into heaven as long as I say all of my Hail Mary's. You have a nice day and may God Bless. This is a good example of the pirate mentality. I have no idea whether you run commercial karaoke shows or not. If not, you can rest easy; there's essentially no chance you'll be targeted, because there is no mechanism for us to discover what you did. But you're deluded if you think what you've done doesn't cost SC a penny, just because you would never have bought the product in the first place. You may not have cost SC directly, it's true. But your actions have consequences. You have provided your pirate vendor--a thief--a portion of the resources necessary to continue his pirate operation. You may not have bought all of the products embodied by what was stolen and sold to you, but you have clearly satisfied a large portion of your own demand for the product, thereby eliminating the necessity of buying ANY of it. You have encouraged others, including commercial users, to follow in your footsteps. And, perhaps most dangerously for the industry, by contributing to piracy, you have made it just that much more difficult for SC to return to production. I really couldn't care less about what your priest thinks is dire enough to keep you out of heaven. I find that you don't have much of a conscience, but that's not my problem--it's yours. But attitudes like yours steel my resolve to do something about this problem. You think your side has us on the run. Keep thinking that.

I wonder how many people spouting off have even been in a courtroom or involved in a criminal and/or civil case and making contributions to those cases either for the prosecution/complainant and/or the defendant/respondent, let alone picking up and reading any law books. I doubt very many. But you are entertaining.

You discovered what the Karaoke Kandy Store did and you lost your A$$. You'll be steeling your resolve while the real pirates will be stealing your wallets. Your only claims against people are for Trade Mark Infringement. Of the TWO requirements needed to determine Trade Mark infringement; I don't meet either one. None of the tracks that I take out of my house have a Sound Choice logo on them and I never try to sell any karaoke tracks to anyone. Sound Choice as a company does not exist in my karaoke world. But since the Karaoke Kandy Store was found innocent, maybe I should get into the hard drive selling business? Oh that's right. Then I'd have to pay for licenses like Sound Choice never seemed to do on many occasions. I think I'll just keep doing what I've been doing. Uh oh. I think I hear Springsteen banging on my door.

Do you also replace the lyric sweeps? By the way, if you use those tracks in a show for which you are paid, or that is used to attract paying customers to a venue, then it doesn't matter whether you are selling the tracks or not. LINE BY LINE SWEEPS ARE MUCH MORE SINGER FRIENDLY. I ALSO CHANGE ALL OF THE COLORS TO MAKE THEM EASIER TO SEE. BLUE LETTERS ON A BLACK BACKGROUND ARE VERY DIFFICULT FOR ME TO SEE. I ALSO ENLARGE THE FONT TO MAKE THE LETTERS BIGGER SO I CAN SEE THEM FROM ACROSS THE ROOM. I DON'T DO ANY SHOWS AT ALL. I'VE NEVER MADE A PENNY FROM KARAOKE. EVEN MY KEY BOARD LIGHTS UP SO I CAN SEE THE KEYS BETTER. I guess with my bad eyes, I've been mis-reading all of the information on that Karaoke Kandy Store case. I could have sworn that I read that Sound Choice lost the case and was ordered to pay the legal fees of the defendant. I guess you're just spewing out more legalise Mr Spin Meister. ARE WE NOW ARGUING OVER THE TERMS "INNOCENT" AND "NOT GUILTY"? SILLY SEMANTICS!
