It was stated on this site, earlier that SC was in negotiations with Sunfly and the other UK brands to do investigations on their behalf, here in the states. I was wondering if anyone had any information about this. I have been looking online and have found nothing.

Well, I inquired about this myself....
(I love this whole email thing.... it's amazing what you can learn)
So sent a few emails out and got this statement back from a manufacturer that resides "offshore."

The operative word here is "negotiations". Until that is finalized, it seems silly to speculate on how it would be handled. The specualtion does nothing but polarize people with a bunch of unknown factors. The negotiations may fall though completely or they may work out something viable. We will just have to wait and see.

The most recent suit we filed included claims under § 43(a) of the Lanham Act for false designation of origin based upon the use of pirated copies of tracks belonging to other manufacturers, on the theory that the use of those pirated tracks damages SC by allowing pirate KJs to compete unfairly with SC's legitimate customers, which ultimately costs SC sales

He's talking about this statement that was made in a karaoke publication that I posted in another thread.

"Since investigators for Sound Choice discovered a growing level of Sunfly Karaoke, Zoom Entertainment and Mr. Entertainer songs being played, they are in discussions with these UK companies to represent their Intellectual Property interests in the U.S., with possible lawsuits for these brands in the future."

Maybe there's a growing number of those tracks being played because those brands (unlike SC) are actually making NEW music that people want to sing? Sorry, you can't blame everything on piracy or people trying to do something illegal at "your expense".

That has always been a goal of ANY good kj to get what the singer wants.

I just don't like the twist being put on it to justify some need of more lawsuits on "behalf" of others. No thanks!

That is what happens when greed and power take over. Sound Choice seems to think that they are STILL the top of the Karaoke food chain. Sorry, but when you haven't mde any new product since 2007 or whatever, you lose the top spot.

Now they can't find enough instances of use of their product to sue over so they want to also investigate the use of ANY karaoke track.

Heck, it's not even "illegal", just non-compliant to SC's wishes. All cases are civil, NOT criminal. They just like to toss around words like "legal" and "pirate" (who is someone who steals, not a media-shifter), and "counterfeit" (an imitation made to defraud for profit, not a media shifted copy of an original from which no profit is gained/ no monies lost by the display of said logo).

I guess they like "inflammatory-speak".

I don't expect to, because I don't represent those companies.

Besides, one company can't "represent" another as a plaintiff in a court proceeding.

The guessing games are whether or not you think SC will sue on behalf of others.... not who wrote the email.

Put yourself in the situation:
Would you trust a competitor (even a former competitor) to sue "for you" in a foreign country? If SC were to sue and fail, the judgment would go against you -- not them.

Would you want to be that disconnected from your own lawsuit?

To the best of my knowledge,

Nothing was ever said about suing on behalf of another company, I think the original idea was an agreement to be reached that would give Soundchoice permission to audit their tracks on their behalf and submit the results of that audit to the companies in question. What the specific companies choose to do if someone 'fails' an audit would have to be completely up to them.

Of course now people will just say that soundchoice would use this as an excuse to find more people to sue in the UK so l think I will go put my earplugs in.
