So I guess the B&Es I've investigated in my career never happened. I have a great sense of humour, just ask anyone who's met me. But I've also seen where a criminal will take advantage of certain information. Donny was very lucky that the idiot who stole his discs was stupid enough to try sell them in his area to people Donny knows.

SINCE YOU HAVE THE ORIGINALS BACK, it would be a great time to Photo them, and take them down to your insurance company and schedule them. Then They cannot deny you if it should happen again.

Thank you to those who wished me well. However, me thinks some one who believes he's the only one who "investigated" for a living should know that he's not the only one who did that for a living. For the record, I've had over thirty years in the business he SAYS he's in, and his comments weren't appreciated, expected, or wanted. Anyway, I just told him to "do" himself.....he probably won't be missed anyway with that attitude or, excuse me, "sense of humor" Still a putz.

This IMO would be a compelling reason (again I state IMO) to allow original purchasing parties the right to back up THEIR OWN purchased originals and use them (in cases of theft). Such an episode sounds as if it really falls within "fair and reasonable use". To NOT use backup copies in fact would be detrimental to the business person. He has a responsibility to his venue.
It's really ashame the onus is placed on the non-trusted original purchasing party to prove he's not pirating. In this case the individual is not gaining any additional income from using his backups, no damage is incurred to anyone else by such use. The originals aren't loaned or sold to another party that gains financially, the owner of the stolen merch certainly isn't benefitting from not having the originals. The entertainer just isn't trusted. *From MY perspective* if an item is stolen and the entertainer needs to resort to a backup copy, this type situation in no way appears to preclude "fair use", it seems quite a reasonable responsible option in fact ! But hey, that's just MY feelings on this.. What happened to Donny sounds like a VERY reasonable case in which the original purchaser (EVEN in a professional commercial setting) SHOULD NOT be assumed guilty of "copyright violation" if there's a police report and evidence that the original copies were in fact stolen, (or it's likely the originals were stolen even assuming the entertainer doesn't currently have evidence that these were in fact the originals that were taken, it should be assumed these were the originals). When a person can legitimately state "I am using my backups because my originals have been stolen in a B&E, the vehicle they were stolen from was broken into the windows smashed, I was vandalized and this is documented", NO WAY should this individual using his backups in such a case be held guilty of Copyright violation. This is beyond anyones control, there's no intent to defraud by the individual using his own backups. It's as reasonable as making a carbon copy of an important thesis in lieu of what will happen *IF* you somehow lose the original. I suppose to me this is an extenuating case and a great example of when copies (even of copies) SHOULD be allowed in a pro-use setting.
Again JMO. Yeah sure, I know some people exploit systems but still, if there's a police report documenting a vehicle was broken into, and contents were stolen for an entertainer not to be able to work without fear of getting busted for using copies is just wrong. This is one of those "grey" areas where you folks that KJ really shouldn't have to worry about this crud.
So copy away everyone, and tell the Karaoke cops Kappy said it's OK
(and see if you can say "Karaoke cops Kappy said it's OK" three times fact without goofing up) LOL Good tongue-twister !

Yep, as I see it *intent* is a pretty large factor that's overlooked in such a case Donny. The intent for using your backups or duplicate copies seems reasonable to me, now I suppose if you had other reasonable options, such as the sellers of the original copies would be willing to fed-ex you loaners at no expense (perhaps just a security or collateral deposite) when you are a victim of larceny you'd have other options, but as things are currently set-up you gain nothing by having backups, you'd just incur more hassle in fact if you do not cover yourself. My feelings are that as adults sometimes it's not always wrong to trash the all/none by-the-books type thinking and function within what we feel is a reasonably grey area, despite what laws currently dictate. Reasonable judgement isn't a bad thing depending on ones intent. Life has enough headaches. If I pay for my originals, and can't attempt to hang onto the priviledge of using what I fairly purchased in a crises situation via backup format, it just seems I'd have a very strong defense in court assuming somebody cared to spend time and money chasing me in such a case. Doubt there'd be punishment, I'd take the risk personally. Of course this doesn't mean wanton duplication to sell and loan-out to others, this means in the case of theft in which I lose MY OWN originals, *I'D* suffer monetarily assuming I didn't have backups, OR unforeseen loss situations, stuff beyond our control etc.
No, I don't have the right to write my own laws this is true, but under CERTAIN circumstances I'm going to think of *MYSELF* as being number one.. Meaning, no alternate sources of playing music, no gig, and I lose, the venue loses, and NOBODY will reimburse me for these particular losses (such as lost wages) or what else can culminate from not having backups, or just general stuff that also results from my work-tools being stolen, and that's just not balanced IMHO.

![oh yeah :oh yeah:](./images/smilies/emot-woot.gif) Problem with growing up in the Metro area here in the Northeast Billy, was people were pretty cold and distant. Money was the value, not people. "supposed" friends were backstabbing and screwing one another in nasty ways, and this was all too common a behaviour, not exception. I never did like what little values I saw trickle down even to the kids in some of these areas up here in the affluent areas outside of NYC..
Weird thing, when I turned 16 I didn't even want a car, reason being was that my folks wouldn't have payed for my insurance, gas,etc.. Many kid's around here did get nice new cars if they wanted them, but not necessarily because the parents personally wanted them to own a new car, it's worse.. Because the neighbors bought their 16 year old a new car... My folks were pretty strict, I'd have needed to pay my own expenses, and I didn't get anything highed, or that special handed to me. I started working part-time at 11 years of age, had to pay rent as soon as a turned 16 (portion of my allowance) for food and clothing.. Nothing much, but still, the folks instilled the meaning of the tax-payers buck in me, I didn't get stuff handed to me TOO much, at least not compared to some of these neighbors that were well into 6 and 7 digit incomes back in the 60's, but since the folks weren't poor, I suppose it'd be wrong to say I didn't have it easier than most (financially at least), if for no other reason than it was there if needed.
Yeah, I think I'd be more secure with myself today if I grew up in a smaller southern, or mid-west location, but I don't know for sure I guess, no way to know these things..
Anyway, back to Donny's thread, sorry for threadjacking. I wouldn't mind living up in Boston btw !!! ![LOL LOL](./images/smilies/emot-LOL.gif) I'd be at Berklee every day !
