If it's 99% or less .......1% looks pretty big to a lawyer. 1% 0f a million ain't a bad days work. But they want 40%......that looks even better.
Even if you would win or have an out of court settlement, you would still lose thousands of dollars. And that's to win...

If you were at my show, yes I would post it if it was taken in the club at a show. You could do nothing more than ask to have it removed then it would be up to my discression, but chances are good that I would. If I was taking pictures of people in compromising positions, or blackmail type photos, yes then I could see a lawsuit, but they KNOW ahead of time that we take pictures for our website. MANY people even send me photos of their parties that they have taken. Some of them I wouldn't use, but the singing pics - sure.
You really think newspaper photographers get the written consent of any person in photos? Many of these photos end up on the web on the papers own sites as well.

Who opened up this can of worms? It was'nt complicated until BD got involved.
Anybody ever watch CHEATERS, some of the stuff those guys do really rides the wire on legal issues. Hidden cameras in peoples homes (with the suspicious ones approval). I've seen some very bizarre episodes, lots have threatened to sue...their still on the air every week. If its broadcast or advertised in plain site, not much the patron can do but request their abstinence from photo shots. Lonmans right, the bar covers itself by letting it be known beforehand. Kinda a like putting up a "No Trespassing" sign after a couple break ins...if they break in again...Katy bar the door. Do ya' feel lucky punk...well do ya!

We have people in the bar taking pictures with their camera phones all the time in the bar.
There is one regular who never wants his pic taken and he just nicely tells people so.
This is a mole hill made into a mountain.

It only takes one mole......with a good out of work lawyer....
The idea is to get people in the bar. Now you have put a limitation on who comes, if they don't want their picture taken......

Then they say hey do you mind not taking my picture & we don't. What limitations do you speak? I see none.

But if it's part of the bars routine, absolutely nothing that can be done about that either. Hell some bars even make videos of the singers.

There is nothing illegal about videoing or taking pics of people in public.. However you cant broadcast the the videos or publish the photos with getting them to sign a release form.. You need their permission not the states or Czar of Russia or anybody else...
Some people dont like their pic hanging in a bar No problem take it it downn....

I would think the answer is simple - if you're worried about a law suit LMAO
When you sell the picture or video to them have them sign a waver.
Lostinvegas are you worried about above accusations that you will be sued?

Everything is by consent and/or request by that person. Everything after they request it clearly states "Bottom Line Karaoke reserves the right to use pitures for promotional blah, blah, blah. If they do not sign, then we do not do. Hopefully it will never happen but if that ever comes up I have paperwork to back it up.

I take pics all of the time of singers dancers whatevers going on around me. I post them on my Website and let my customers have them for free. Charging is a bit greedy you should be making enough for your gig without padding it.
