It's a problem concerning any employer ... EMPLOYEE THEFT
Whether its files , discs, or even GIGS ..tell me that hasn't happen to some of you.
It just comes down to screening your hired help and doing your due diligence in checking on referrals etc. Stay on top of your hired help and check up on them regularly ...Good luck !!!

Quote: But would you call the police and make a theft report on a 'technically' illegal hard drive?
Well if you were legal, it wouldn't be a problem now would it. Now we can see how it can escalate. Your employee steals the hard drive and copies it many times and sells them all over the place because you were doing something illegal yourself and are now afraid to call the police. Sort of similar of a drug dealer stealing from a drug dealer. Yep an "innocent" protection of files have now become pirated booty.

Well, if you were "legal" (ie: still used discs), that still dosen't protect you from theft. Your employees could take the discs home and rip em, just as easy as thy could take the hard drive home and copy it. It may take a bit longer, but using discs still dosen't prevent theft.
ANd, in fact, if universal shield 4.1 has all levels of protevtion including encryption and you can choose the trusted programs or processes, it would be easier to protect from copyright violations, rather than using CDs, wich can not be encrypted.

Ah but if they stole the discs there's not the problem of not contacting the police to have that employee charged with theft. BTW it's not to difficult to find what's been copied to a hard drive and when.

We have been down that road and we solved it in a logical manner and didnt have to play cops and robbers like you want to turn every thread into. Do not insinuate that we are running an illegal show..... We have came up with a viable solution and yet you dont want to listen to someone with experience, you want to pollute another thread with legalities which might or might not pertain to our situation. You dont know the negatives of calling cops into a bar down here or the politics involved.

What are you afraid of. Just because you believe something is ok, does not make it legal. This just proves the biggest downfall of hard drives.
I cannot help it if you work at a bar where the bar is afraid of the police for whatever reason or the "politics". Give me a break.

Quote: What are you afraid of. Just because you believe something is ok, does not make it legal. This just proves the biggest downfall of hard drives. Afraid?? Son I fear no one.... Not on a forum or in real life... If I want legal advise I retain one of the best attorneys in the business.. And I am tired of the insinuations and posters wanting to shove legal advise whic I dont need and it isnt worth a s***.. Quote: I cannot help it if you work at a bar where the bar is afraid of the police for whatever reason or the "politics". Give me a break.
Insuations again son.. Did I say we feared the police? Insinuations again of illegal activity...When police are are called into a bar here for whatever reason it is a strike... Depending on the severity a few strikes mean 10-30 days shutdown....
So give me a break and knock off the insinuations that I or anybody else here is shady or ilegal or does not know how to deal with real life or bar situations.
I got a better idea If you want to come into our bar that is afraid and register a complaint here is the web site
The mgrs name is Rick Garza Here is his pic so you will know who to talk to...

OK, so since you are not getting it....ONE MORE TIME REALLY SLOWWWWWWwwww.......
1. Employee takes your dics home
Got that?????
2. Employee rips disc to his computer
With me so far????
3. Employee returns disc, without you ever knowing it was gone
OK, this next part might be difficult, but try....
4. You call cops to say you stuff was stolen....COPS LAUGH AT YOU, casue you still have your discs.
Original this post was about employees taking home music, and copying it, not actually KEEPING the hardware.
And, it is not illegal, All I have to say is that it is for my personal use, therfore not illegal, and no worries on calling cops.
And BTW, it is EASY to change the date/time of anything that has been copied to the hard drive.
And now show me ONE, and only ONE case of a KJ or DJ that has been busted for usings computer 1:1 copies of music he owns on discs.

Now get this, if you don't know you're discs have been stolen and returned, then you do not know there has been a theft. That's not the case here. The employee has been caught by the employer with the stolen disc or harddrive. That is theft and theft of intellectual property and further, if they have been copied, a violation of the copyright law. If the police refuse to investigae then launch a complaint to the Police board or the equivilent in your area.
Until the law is changed then yes using a harddrive with music that has not been authorized is illegal no matter how much you want to justify or rationalize it.

I, the original poster, was not talking about theft of a phycial device (cd/hard drive). What this thread is about is theft of just the music.
I am not trying to rationalize it, but we must live in raelity. There are a lot of laws that are not rational ( http://www.dumblaws.com/ ) and are not enforced. The law making it illegal to format shift for comercial is another example of a law behind it's times.
Again, show me ONE case where someone has been busted for format shifting (1:1 ratio) and using it in a comercial enviroment, and has got busted. Yeah, technically it is illegal, but it is a un-enforced law.
ANd sice you have NEVER broken the law, wetyher you got casught or not, I guess that makes you a better person than me, and I can live with that.

Did he not have to physically have to take the harddrive to copy it? Whatever is encrypted on your harddrive is now encrypted on his. The tech boys (and girls) can easily prove this.

OK, one more time SLOWERRRRRRrrrrrrrr..........
1. You running a show PC based with extranal hard drive.
2. DUH, not encrypted, casue that is what this post is about, finding encryption software.
3. Your hired help take the harddrive home and copies, and returns it the next day.
and one again, it is EASY to change the DATE/TIME stamp of any or all files, so the tech boys & girls won't have a clue.

Show me a statute passed by legislature or covered by any antiquated law that governs or restricts ripping cd's and using them for DJ or KJ either federal or state.....And then tell me what law enforcement agency is authorized to enforce them...
With the current world situation and all these sex predators on the internet and all this important demented stuff who gives a sh** whom is singing down at the local tavern..
I am tired of all the the bsss on this forum You know who I am You know where I work You want to play with the big boys and put your fantasies to the test and tell me us how to operate then come on .. You want the local police or Weld county sheriff officers number? Better put a real name behind your avy now Quit trying to tell us how to fu** live...

It may be "easy" to change the date, but it doesn't "change" the date. Further, depending what is on your disc/harddrive (you did copy from disc right?) then a match is more than possible.
Your hired help takes the discs or hard home, copies them and return them next day.
That is still theft. That is still a violation of the Copyright Act. Both are violations of the law. If your police aren't acting, then they are not doing their job. And don't tell me they can't. Been there got the t-shirt.

Tim, there are utilities that can update files and can modify all sorts of data, including create date, date last updated, etc.

And the forensics techs can get through that. If you think you can erase a harddrive and you're in the clear, you're not. Many are in jail because they thought so, business people, people into kiddie porn, pirates, etc.
