Since the subject is out in the open, lets's disscuss the facts.

Every web site and chatroom goes to great lenghts to protect the identity of all persons equally.

Safety and Privacy are the main issues.   There have been people stalked and killed by crazies all over the world.   Mine, yours and everyones safety should be top priority.    Putting someones name, Phone, address, Email address or other personal information on a public site, isn't a smart thing to do.  For any reason    

NOW do you think that if such action caused personal injuries, financial injuries or death, there would be no liability to the person that made such actions?   Just a question.

Absolutely none, otherwise all those "Maps to the Stars" companies would have been put out of business and sued.  If you own property anyone can find out through their local Registry Of Deeds office because it is public information.  As I said before, not illegal but may be in bad taste.

In order to answer that, you'd need to see how the Federal Electronic  Communications Privacy Act reads today, and see the particular BBS disclaimer, or ISP disclaimer.

I could sue you if I came to your house and claimed I got a hang nail.  Doesn't mean I'll win, but I can still do it.  And you would still have to defend against it.

If it could be proven that such information caused bodily injury or death.  Tell me a lawyer that wouldn't take the case?    You can still be held liable for your actions.   Or lack of actions in some cases.

Burdon of proof isn't as easy as you might think.   What evidence do you have based upon type in a chatroom ?  How do you know Steven Kaplan's actually the one typing this now ?  He's asleep,  I'm just a houseguest that broke in and saw this site on his computer.  I suppose he leaves it on in this place when he sleeps... Just so happen's I tried to sue someone around here for a hangnail I got while trying to pry open their double hung window, problem is I couldn't find an attorney that would take such a frivolous case on contingency, and the money the atty's wanted up front just to get the case into court wasn't worth the remote shot I'd have at even recovering half of the fee's in a personal injury settlement.  I could only recover (maximally) a percentage of my medical bill, and that's assuming I have proof that I received the hangnail while at the person's home.. Obviously, there were no witnesses. I'd need to produce proof, How can I ? and there'd be little chance due to circumstances of me recovering punitive damages assuming there was proof, the possible ramifications of my turning myself in however, and revealing that this happened at this person's home would be far worse of course !...The Atty told me that the person could file a countersuit against me that would cost me a fortune, because assuming I could produce proof, he too would have proof of damage by me incurred as a result of my own actions breaking and entering..

PS....I'd wake Kaplan up to read this, but not only would that not be polite of me,  he's never seen me before, and I'm really not supposed to be here,  I'm a burglar.  Wasn't born yesterday either !   Incidently, I'm starting to doubt that this guy's real name is "Steven Kaplan", I think he's putting you folks on.... LOL, This is some strange old chick's house... There are teeth in a glass next to this damn computer,  BLECH,  I'm outta here...This is disgusting !

Info on the net are public domain. Any info you put out about yourself, your opinion, your political inclination etc, will and can be retrieved by anyone who knows how to Google their way thru the net.
Being anonymous and using screen name does not guarantee ones' true identity. Email address are not show in this site because the site owner do not want people to abuse it, ie spammers. Email also have your IP.
Just remember, your true identity is not difficult to find out.

Your IP is just a general area in some cases.  If you have a provider such as AOL, you are a node...Unless you have cable... In most cases in order to get an actual address you need the info subpoena'd.  I make certain my IP is never exact, sometimes it means going thru several sites...  Currently my IP would only show you that I'm part of a Texas area group....in one case IP identifier showed a closer address,  Danbury Ct....  (120 miles away from me).... Truth is, You could find me ONLY based upon info I'VE given you here... Any exact info, would involve the law requesting my ISP to turn over info... You yourself can only find me assuming I tell you I'm Steven Kaplan, living in _________ Ct.  WHen a person has dialup, or even broadband DSL,  they try to tell you the person can easily be identified by IP...Fact is, it's not quite that easy unless they have cable... and they have an exact location, and aren't running from a larger ISP's node someplace.... Most ISP's today also provide privacy to their subscribers.... Not just anyone can get info.

Yes, Depending on the magnitude of the illegality, the police can subpoena certain information.  Assuming the person has a system with a router, or the IP is a college lobby... or public area with MANY users... The culprit will not be found in most cases. Evidence is not as easy to obtain as some might think... Even assuming I make a call from my home, and the person has caller ID... It's quite easy to get out've even THAT situation!   Only in Hollywood, are criminals so easily caught with such frequency.  VERY few people are prosecuted for slander in civil cases successfully in real life, it just doesn't happen on the internet... You'd have a tough time finding an Atty to take such a case.... If it's a capital felony, yes... They go all out.  They can find out who makes death threats, thwart murder's in some cases, and in the case of national security matters, they often do use the internet... All depends on the magnitude... Whether or not they want to expend effort...

I have never used a handle... my name IS Gilly.... I can't handle a pretend "Dress-up" name, because, i never recognize when someone is talking to me..... I am not too smart;)

And, lots of people know exactly where I live. Doesn't bother me in the least.... if someone wants to stalk me, I am flattered. (plus I live on a tightly patrolled military base, with an mp next door... come get me i am bored;) Lol.

I "grew up" online..... have met a gazillion people from online chat rooms, and forums,  starting when I was around 12... and only ever had two bad/odd experiences.

Even after those, I am not terribly concerned with internet safety. It is simply really easy to find out all of that information online, with OUT my help, so, i don't concern myself with worrying about it.


(plus, I am really immature:)

My view is that the internet is a relatively safe place when compared to walking down a street. There are always people out to "get you" in every walk of life so you need to have your wits about you.

Unfortunately the internet and technology has given criminals the ability to automate crime meaning they can target many more potential victims.

But the biggest security issue with the internet is the people who use it and their woeful lack of knowledge. This puts a huge ownes on software suppliers to stay one step ahead of the game to keep people out of trouble.

Generally people would think twice about taking a shortcut down an dark alley, or walking round with wads of cash and jewellery to minimise the risk of being a victim of crime (call it "streetwise" if you like) but online people are somewhat ignorant or blasé and fail to protect themselves.

In many cases such as with Phishing even people with some knowledge can walk blindly into a dark alley without even knowing it.

The bottom line is that the internet is insecure by design and it is up to the user to learn about the threats and counter measures before indulging.....after all you would be foolish to jump into a river without first learning to swim!

That is most certainly true, but if found to be frivolous, chances are very good that you will be ordered to pay the Defendent's costs.

What if I win?   You will pay the damages and costs.   It's not that far fetched.   Or you will elect to settle out of court, just to insure your damages are kept low.

Wouldn't settle out've court, I'd laugh that you paid even the nominal small claims fee, paid the sheriff (around $75) for serving me papers, and I would carry this over to the main docket so their's an appeal process. I'd either quash the subpoena by forcing deposition at my home (You'd never recover your fee's), or file countersuit that would make your odd's so slim, a court would likely question your competence, intent, and add on psychiatric evaluation as part of a settlement in addition to your cost for ALL of my Atty fee's as well...  If you get pleasure out've paying two atty's for this case (let's say around 10K when all is said and done) your fee just to bring this from small claims to the main docket, and other fee's I'd drag out and mount up, (assuming you could find an atty that's willing to take such a longshot case to begin with,  this isn't quick money for him... Chances are he'd get very little, and would advise you at some point not to proceed, MORE THAN LIKELY at the onset assuming he took it after your initial consultation, called me, and I told him your were lying). Your atty would also be made to look ridiculous in such a case... This case would likely never get to court however,  it'd get nullied by the court... you'd have paid a few hundred dollars for nothing...

Yes Bab's,  and yesterday he lived in Korea, the day before Mongolia, prior to that Cuba, etc.   It's obvious why that is however,  he's traveling on a mission to spread "good karaoke"
