As I said before other than giving false identification (ie a false licence at a traffic stop) or after arrest (the only other time you must identify yourself to police) or making a false report, it is not a crime to lie to police, but it is stupid. You are not required to show the police any identification if they stop you on the street and ask for it. If they do it is unlawful detainment. You are not required to take an oath prior to talking to police, unless you are making an affidavit. You cannot be forced to make an affidavit. Again, let's see it in writing.

Quote: I'd like to see where that is written in a Criminal Code or Penal Code or whatever you call it down there. If it were in fact the case where lying to the police is a felony, the jail would be overflowed with people doing time just for that. Show me where it is written and for what state.
A "False Report" or "interfering" with police is a class A misdemeaner. Perjury under Oath is a Felony in a court situation. I'd have to break down, and find you the specific's if you want them... Yet you can look them up as well... I was just speaking to a buddy who's a Criminal defense Atty, and I was incorrect about Felony, in this case, it's a Class A misdemeaner.
(of course when the police "lie" to an individual, it's considered clever police work)

Making a False Report and Interfering, also known as Obstruction, are specific crimes as is Perjury, or lying in an Affidavit as previously noted, but lying when questioned by police is not except in the previous stated examples. Man if lying to the police were a crime, I could have filled up a couple of prisons all by myself.

Tim, You are correct, What I should've said, is that "assuming he filled out a police report, knowing that noone in the bar detained him, and he filed a false report deliberately", that's a class A Misdemeaner.. It's called making a "false report"...
Now assuming his local police, and court system are already sick of this guy, how they care to pursue this in addition to other charges, is up to them..
Yet big dog should not have been punching the Seagull's around his head trying to assist him that much..That's a whole different issue... It's Assault.
I doubt this bar owner is going to say that what Big Dog dog did was in the best interest of her business, and stand behind it. I think Big Dog is going to be on his own in this "Parking lot fight".
It was sort've funny in the early 70's Tim, when I was playing upstate NY clubs, and basically living in bars..... So many times, the bar owner, would excuse a doorman, and let him go home early.... and he'd punch out..... So he could go after someone who he felt compelled to punch out.. Yet while these people were working.... If someone pushed them out've the way, they'd usually take it... You have to... The vigiliante stuff doesn't cut it in court systems...IF someone blocks you, or stands in front of you... You can't start pummeling them.... (At least in those days, in a few states around here).... Excessive force was ALWAYS the first thing one of these mouthy A-holes would attempt to pull off.... "He punched me, I never punched him"..
Now if the doorman was positive there were no witnesses, and willing to do a little extra something on his own, and lie.... Now that made sense LOL ..Just be careful where you leave marks
ADDED IN:
It wasn't uncommon for whole bar staff's to lie under oath... if someone was drunk, aggressive, and they felt they could get away with it..
Judges and atty's, were so damn sick of "bar brawls", and alcohol related behaviour, they didn't take them all that seriously.. If a person (especially in those days) had 7 or 8 drinks in them... They pretty much lost alot of credibility period... Courts hated these types of episodes taking up docket space.
In this particular case, I was speaking of "Filing a false police report", and I was incorrect about it being a felony.. It's a Misdemeaner

Idle threats...do what I do as a preventative in cases like this, just pepper spray in place of your usual hair styling spritz or gel. Keeps those bullies away with great efficacy.

... Yep, that certainly wouldn't hurt my social life either MJK.... there is none... Maybe I should go to CVS, and see if I can find "Score", or "Command" hair creme with mace..... Hmmm.... Command, and Score were discontinued around the time "Robert Hall" dept store went out've business come to think of it... A few years back..... before color television....OK, NOW I'm getting depressed !!
MJK, Have you ever been to any of those "Strange NJ" sites, about the "legendary" sites ? I used to go to "Land of make believe", but never the "Blue Hole"... that sounds interesting....

One thing I recall from the earlier elementary school years in NJ, was what seemed to be a pretty high percentage of residents of the state who've seen UFO's...
In fact, I think that's the New Jersey State bird.... "The UFO"

Well, I did live almost across the street from the "famous" Elephant Hotel. Don't know if the noteriety of that one reached your regions there. It possessed the last remnant of a truly remarkable ugliness (apologies to O. Wilde). If you're not familiar with it, it was what it sounds like.
Steve, I myself DID see what is technically a UFO. I was sitting on my front poor in the summer (what year I can't even remember-I was about 19, 20) and floating directly toward the direction of the beach was this HUGE phosphorescent blue rectangular object. Being of a scientific bent, I quickly ran through the list of things it could be. I knew it wasn't a Goodyear Blimp (we had a lot of those) and it wasn't a spotlight moving through the clouds because this was moving in and out of some light cloud cover. Had I not been in my pajamas, I would have followed it's course toward the ocean. I would have paid anything though to see one of your standard issue Klaatu type saucers!

Are you related or were related by any remote chance to a Shirley Kaplan or had a relative in the candy business? This is like when I visited Russia in the 8th grade and my science teacher took me aside and informed me that he had a uncle named Shlomo out there and if I saw him to say "Hi" from Abe in the States. I kid you not!

, Sometimes I wish I were a gentile !
Not sure about Shirley Kaplan. My father's father is Lithuanian however. and Kaplan of course is abbreviated from some longer 80 syllable russian type name ... I don't even know what my actual last name is I suppose, Michael
probably something Russian such as
Kaplantypestoomutcz

I heard through the grapevine that chipmonk wants me to pay for his broken glasses. Yeah, only if he's going to buy safety glasses. He'll need them again.

Seem's as though Peabody should've thought of removing his own bifocals before banging you in the knuckles with his face

Here is the best part of the story... The girlfriend goes to work today and the bar owner reamed her a new one. She said nothing of me, but went on and on about how much trouble the girlfriend got her (the bar owner) into. He's barred on the days I'm there but not when she works. Someone else told girlfriend that chipmonk got grabbed by the throat a few weeks ago for mouthing off to someone. Total a**hole....... Him and the bar owner.

We talked to the DA today. In order for her to file stalking/harrassment charges, girlfreind has to send chipmonk a registered letter. Explaining that she talked to the DA about filing charges against him. And that he is not to have any kind of contact with her or the charges will be formalized. The victom has to warn the attacker, to be a good boy????????????? No wonder people get killed.

She shouldn't send the letter, she should spend a few bucks and have an Atty send a letter... Document each time it happens, keep a log... I didn't know it was mandatory to "warn first". I thought that was an option. SHe has witnesses. Have the court call the bar... Owner received a phonecall warning her that this girl was being stalked by a friend of the stalker's correct ?... The police should notify him that they have a signed complaint too. Police around here call a person if a complaint has been filed about them. A signed complaint that is.
