A little over 5 years ago my girlfriend bought a karaoke system w/cd's for 3500.00, from a local guy here. She's ran a show once a week since then. I started helping her last October and became educated about the industry...Well she didn't know about copyright laws, and I have scrambled to make us legal. Mind you, we have never downloaded a song and everything we buy is legal, recently adding the CB 6000. We plan to buy the SC Gem in May (still paying off CB)...So heres the question. The package she bought from this guy had 184 cd's some 3200 songs, all bootleg. It included mainly SC, but also CB, MM, Top Hits, Pop Hits, Panarama, AH, SGB, Legends, you name it there was one of them in it. So we're dishing out all this money now to do whats right, can we take this guy to court to recoup some of our money after 5 years? We have very little funds for an attorney... Oh did say we have a bill of sale? Thanks |

Oh did say we have a bill of sale? IANAL, but my guess is you are limited 5 years later. Statute of limitations is typically way shorter than that. |

There are some states with breach of contract, breach of warranty, and unfair trade practices statutes of limitations that are long enough to take the guy to court, still, and for that amount it could probably be done without an attorney in small claims court. On the other hand, if the guy is still selling or has sold to others more recently, SC might be interested in taking a more active role in pursuing him. Well we're in Texas. The guy sold us everything saying he was quiting. Well, he bought new equipment and later started doing gigs with the same music. As far as I know we're the only one who has bought from him... |

My issue with SC has always been about hassling the INNOCENT. However, if what you say is true, then this guy is a proven PIRATE (track thief). That being the case, there would be no reason not to tell SC about him. EXCEPT, your girlfriend has been running a show with these discs ( even though in good faith). As soon as you report them to SC ( even through an anonymous tip on their site, your name will come up from the seller and the case in question- and I believe that they will come after you, too. No reason not to try Athena's suggestion in regard to Small Claims Court, but I don't know how binding that court's decisions are in your state. A little research on that may help. |

If they are purchasing the GEM & CB sets like they stated to get rid of the burned discs in question, then SC/CB would not worry about them - as long as they are really getting rid of the burns. |

I've been up front with everyone thus far. Both SC and CB have been understanding. There response has been if everyone was doing what were doing, there wouldn't be a problem in the industry... |
