Now you are at the heart of this whole "piracy" problem. So if the TOS say no commercial use what does that mean? I read it to say no commercial use, period!
We are all complaining about the piracy, level playing field, fair competition and so on.......

Rick, not trying to single you out, but, (ok I know I am going to get jumped on for this next part of the statement) rules is rules. I don't make them but I respect them and do my best to follow them. Aren't we all here beating each other up over how the piracy is helping to kill this business and yet we justify our own actions for out own means. It is like throwing a cigarette butt out the window and thinking it is only one butt but take a walk along the roadside and see the thousands of butt (now trash) that are there. I guess I am trying to say, where do morals fall into the equation. Just my 2 cents.

What song can they possibly have that is not available through authorizied commercial sellers/resellers?

Is that a terms of use for the website or the songs on the website? I have seen similar pages as Terms of Use just to use a website--sort of like you can view what is on this website (temporarily download) but not save it to use elsewhere or copy it, etc. It may not relate to the licensing of the music???

Which obviously a much better model to follow then some of these very same manufacturers you support as evidenced by the dozens of lawsuits for hundreds of tracks that they produced (read as "pirated") over the years and sold to karaoke hosts.

Every CD you buy says the same thing - ever ripped your songs to mp3 and used them in your DJ business? Why in the world would delivery method matter? You buy the discs, rip them or they rip them and sell them to you.
There is no difference. All Star Karaoke doesn't seem to be running around suing everybody for using their product either.

I'm a big karaoke fan. I have been doing karaoke for a living for several years and over the years I have collected hundreds of karaoke discs. Up untill now I had to buy CD's for one or two songs. Either I had all the other songs on the disc or I just didn't want them. And the cost of most of these CD's were pretty expencive. I bought this card just to try and it was AMAZING!!! I have bought several already. It was easy to use, Just log on to the website, enter my redemption code and select my songs. They have a great website with a search bar. It allows you to search by Artist, Song, Genre and also tells me whats new, Hot and the Best sellers. This makes my job so much easier. The cost also makes my job alot more affordable. Less then [$] cents a song and they pay the shipping to me after I select my music!!!! I selected my music, submitted my order and three days later I had my karaoke disc in my mailbox!!!!"

Guess the work ain't getting out - does this make Target a target for a lawsuit too? We need somebody to ask her where her shows are....

orders a custom Allstar discs using a card purchased from Target? why is that bad?

Oh, if i buy that 200,000 track loaded hard drive i am using it - nobody to stop me - no controlling legal authority regulating that. Do you seriously think no KJs will use them in a show? please....

Paradigm - buying from All Star Karaoke through Target is not the same as buying a pirated hard drive, I don't believe. What's the difference in that and buying from Chartbuster on a USB drive?

it is not that you are buying All Star through target, there is nothing at all wrong with that. Buying the downloads, the initial purpose of the post, which are very explicit in not being for commercial use, is different.
they did not pay the proper fees for it to be used commercially, so it can not be used that way. a USB drive from CB has the proper fees paid and so it is ok.
they didn't just say "for private home use only" they explicitly said you may not " use the materials for any commercial purpose, or for any public display (commercial or non-commercial)"
very different. saying "i don't care i will use them commercially anyway" just adds to the problem of hosts doing whatever they want legal or not and thumbing their nose at the rules. just like the loaded drives.

i will await to hear what they say back to you.

here's the email i received back this afternoon:

The "Right to Use" applies to downloads of All Star Karaoke just as it would to a physical CDG purchase. And, just as a CDG purchase is required for each instance being used for your karaoke business, a download purchase is required just the same.

Basically, if you have multiple people working at different venues, then you will need ONE purchased copy for each.

Note: It is also the responsibility of the venue or KJ to pay performance royalties to the Performance Rights Organizations such as ASCAP, BMI and SESAC.

Let me know if there is anything else we can do to assist you.

Well that sounds to me like I was correct to say I could use the downloads if I purchased them. Maybe I should check with Sound Choice first though just to be safe.... :)

Sounds like their stance is their downloads are fine for club work as long as you purchase a copy for each system regardless of what their 'no commercial use' statement on their TOS is. Maybe that IS for the website and not the music itself.
