Just saw on another forum that a couple of karaoke download sites are not going to offering downloads in the USA. Does anyone know what happed at the mobile beat show? I see the same people advertising here (KS) for downloads what is going on. |

The same people answered you in the other thread you asked about Quote: They are simply an affiliate of each of these services. You sign up for an affiliate and you make a commission or "finders fee" for sold songs. They are just embeded web pages from each of the services. This is similar to adding banner ads on your webpage and a good source of income "if" you have the traffic. They are not distributors of any of these services, but they are doing a good job of driving traffic to each of the services. I would prefer a focused effort but each to their own.
They are dropping the affiliate links. |

So, how do we know what Karaoke download sites (if any) are legal? Is there a list published somewhere? At one time, I used "buy-karaoke-downloads-dot-com" until I was informed they were operating illegally. In another thread I commented that I had just discovered "karaoke-version-dot-com" ... the ONLY place I've been able to find Johnny Reid mp3+g files. Now there seems to be some question about that site too. I really don't want to have to read reams of information about all the legalities and who is suing who... that just gives me a headache. But it certainly would be useful if some legitimate authority would publish a list of what/who (Karaoke download sites) is and isn't legal. I really don't want to be spending money on downloads that turn out to be illegal or even questionable. |

Earl, it is my understanding that downloads are not legal in the USA from anyone....The licencing for downloads does not exsist here yet. |

The downloads that they offered (at one time) were for private (personal use) and not for commercial use, I think due to the confusion they stopped offering them at all, now everything they offer is via physical media. You may not shift the Content of the Original Media to any Non-Original Medium unless you are in compliance with our media-shifting policy: •Provided that such media-shifting is otherwise in compliance with the laws of the United States or Canada (as applicable), you may shift the Content stored on each of the Original Media to ONE Non-Original Medium of your choice. •You must maintain possession of the Original Media whose Content you have shifted during the entire time the Content is stored on the Non-Original Medium. •While the Content has been shifted, you may not use the Original Media for any purpose, commercial or otherwise. •If you desire to shift the Content of any of the Original Media to more than one Non-Original Medium, you must acquire one or more additional original discs, so that you maintain a 1-to-1 relationship between original discs and the non-original media. •Media shifting for commercial purposes is only permitted with the express written consent of Chartbuster Karaoke. To obtain written permission you must consent to an audit of your commercial system(s). That was my understand also...I remember seeing the downloads on the old site and reading the disclaimer. Home use is allowed for some manus downloads (ie karaoke channel) but when you dig deep enough you always find the disclaimer "Home use or fair use" as my IP attny expained "Fair use" is not applied to "proffesional use" wouldnt chance it personally |

OK seeing that I couldn't find anything on their new site I guess it's time to ask again! Chartbuster please tell us if your digital downloads (from your site) are authorized by you to use in a commercial setting (kj show). |

I'm not CB but this is what they have on their new site in their KJ section under their Safe Harbor info for hosts: "Running a Compliant Show Chartbuster Karaoke sells its karaoke accompaniment tracks on CD+Gs or licenses MP3G data discs. If you are going to use Chartbuster Karaoke tracks for any commercial purpose, you must acquire those tracks on an original disc manufactured by Chartbuster Karaoke. * If you acquired your Chartbuster Karaoke® tracks via downloading, you may not use those tracks for any commercial purpose. Further, MOST sites offering Chartbuster Karaoke® tracks are illegal sites and obtaining tracks from these sites, whether purchased or obtained free means you have acquired pirated tracks. If you have any questions as to which sites are legal sites for PERSONAL home use, you should contact Chartbuster Karaoke." |

I don't think you are mis-remembering--I remember it too, although it was always an explanation that seemed like a bit of dancing around and not really reassuring. But they are specifically spelling it out on their new site--including their policy on computer use. Well, it is the latest incarnation, anyway. |

Any download in the US is not legal to use for commercial/business, only for private use. At least regarding to SC, CB and PH: http://www.youtube.com/watch?v=R-YC03mxEQ0 EDIT: They also state that you CANNOT use SF or ZM in the US, since those companies are NOT licensed in the US. How far does this all go? |

This is all addressed in this thread: http://www.karaoke-forum.com/viewtopic.php?t=20719 These products will likely become harder to get, as they cannot be imported into the US any longer. I'm not sure how that will affect downloads. The way I understand it, the European MCPS licencing is similar to the compulsory mechanical licensing in the US. It doesn't cover the sync licence required in the US for the lyric sweeps. Any sound Choice disc manufactured in GB by Mediaplas (everything produced in the last 3 years or so including the Gem series) and the custom SC discs from down under are (IMHO) on the same footing as Sunfly Zoom Legends, etc. I think downloads obtained from a legitimate site (Sunfky & Zoom from karaoke.cc, Tricerasoft, PCDJ) are on the same footing as well, many have paid European MCPS licencing or compulsory mechanical licencing in the US but may not have paid the sync licence. I do not believe another manu would have standing to sue for this. IMHO the only party that would have standing to sue a KJ for using Sunfly, Sound Choice Gem series, Zoom discs or downloads bought from a legitimate site would be the publisher denied the proceeds form the sync licence. I'm not an IP attorney and this is not legal advice. |

I guess next, when you buy a wrench, screwdriver, or paper plate, it will say only for home use, not for commercial use.......hey, as I've bought many electronics, that say not for commercial use(it voids the warranty), but I've used them anyway....maybe "not for commercial use" is just a suggestion.... |
