It turned out to be a charade. SC started talking to Lawyers and, what is happening now, is what it morphed into. Suing some HD seller who hides money or spends it as fast as it is received would only result in throwing good money after bad...might get a conviction but that doesn't translate to recovered money. Why not go after someone who, actually, purports to have an established business with something to lose. I think in the case of the Kandy Store, wasn't the federal government going after them as well for Mail Fraud (shipping cloned hardrives) and the IRS for tax evation. So don't they get first dibs on any property that (if convicted) will be sold at auction? Kandy Store was an established business, right?

People may be confusing two cases that happened around the same time. The FBI served warrants on Dan Stearns/Bill Bene, a hard drive seller on Craigslist/Ebay. Both FBI and SC had people buying hard drives as evidence on that one. I don't know if the FBI was involved in the Kandy Store suit.
However there are pages and pages of exhibits and affidavits involved in the Kandy Store suit as far as evidence. I haven't bought all of it yet but it appears there could be more to it than what we read on here. Maybe a different judge on appeal will view the evidence differently or they will get it together as far as finding the physical evidence. In any case, until the next step happens, it is all just the speculation game again so I don't really have much comment on it until the next thing happens.

First of all, the "federal government" doesn't appear to have ever done anything regarding this case. If they did, I'd certainly like to see something in the way of an arrest, a warrant, a suit or any kind of substantial action. So from my perspective, that was a charade. Second, it's all done unless some miracle occurs with the appellate court.
