It's like PEP saying, 'we're not telling you to do anything illegal, but we'll sell you exactly what you need to blow up this building with the understanding that, if you do, we had nothing to do with it.'
That's exactly what they're saying because in order to receive any value from their product, you have to be willing to knowingly commit copyright infringement. PEP knows this and that's why their contract specifically states that you can't sue PEP for your infringement of a third party's rights (which they acknowledge they cannot grant you in the first place.)

Well, it seems like IF a KJ was sued, and he offers up his "Contract" as a defense, would the suit then include PEP/SC?

I need to think on that a bit.

So, it's true the KJ did promise not to sue, but that document implicates PEP?
:withstupid:

I would bet that PEP/SC is playing the odds just like most KJ's are. Risk:Reward

8) So all anyone is doing here is gambling? They are betting they won't get caught the hosts as well as PEP? Seems rather strange that this whole system is built on a foundation of sand, and any type of shift in the in the substructure brings the whole house down. Retirement is looking better every day.

The issue is, the HELP 'license' is worthless without Stingray's music. Stingray's music (what used to be Sound Choice's music) is now possessed by those that have committed copyright infringement (copied, made copies or received or purchased copied music files without owning the original music source, like the cd). The HELP 'license' ENCOURAGES copyright infringement. Personally, I'd be scared to death to use the HELP 'license'. How stupid can one be?

Exactly. My point was a round about to the same conclusion.

To those still wondering, PEP takes itself off the hook for any further actions someone may get in to for playing stolen Stingray tracks in their small print. Don't forget that this also means the original copyright holders have a claim as well, since they were not compensated based off of a good sale.

hmmm....
so if someone gets caught playing Stingray BRANDED tracks, they will get reported to Stingray because that's bad.
if they play SC Branded Stingray tracks, they get a license and hush hush...

Has anyone contacted Stingray about this issue? Would be interesting to hear if they have some kind of deal with PEP and the HELP 'license' that prevents them from suing PEP for complicity in copyright infringement or something else.

You have "No Standing" to ask that question.
You do not own anything related to the copyrights.
You're hosed.. (That's Lawyer Talk)

Why don't you ask Putin!

He loves karaoke and loves to sing when riding his horse bare chested. It brings out the man in him. :D

PS Rumor has it that Putin is working on adding a subliminal message to every SC song ever made and release them to the torrent sites as 540 kbps HD . The message will chant over and over and over, in your head when you sleep, these words "after my election I will have more flexibility" with "Back to the USSR" playing in the background. I guess Putin loves yoga too!

OMG, I just took my own advice and sent Putin a secret message via a decoder ring I got in a specially marked box of Cracker Jack. He has been hacking the Kingsmen's emails for years and he shared with me the REAL lyrics of "Louie Louie". He sure does love karaoke.

Of course I'm sworn to secrecy, but I have the real lyrics and that's good enough for me. He also said he is working on hacking SC/PEP's emails and getting the real scoop. I'll keep everyone informed when I get more...... if I'm still around

So I decided to press Putin a little harder and he swears he had nothing to do with interfering with our election, but he disclosed to me that he has started buying pants suits for his wife...... which to me is rather suspicious and troubling :?

Business is business. What Pep does with Stingray is none of our business.

Well technically they weren't Stingray tracks when the GEM's were initially created and if I recall there was a 'relicensing' from Stingray to create the GEMS.

For which Stingray was paid the agreed-upon royalty.

Putin just texted me and said he had hacked into SC emails (pre-PEP) and he does verify that the GEMS are legit! He sure does love karaoke. He wants to make sure that it survives. Singing "Back To USSR" is what keeps him going strong.

I would categorize that as another lie because I wouldn't believe that unless I saw a canceled check. The "asset switcheroo" is a perfect method to dispense with any "agreed-upon royalty" liability payable by "Sleptone."
