I told a kj he was a pirate or perceived to be one in a personal conversation. I haven't told anyone else using his name in this context in any way. He now says he is going to sue me for slander.
This can't possibly hold water, can it?

This can't possibly hold water, can it? To make a statement privately to a person (i.e., without others listening) about the person to whom you are speaking IS NOT slander, regardless of whether the statement is true or false. Slander requires (among other things) "publication," which means--at a minimum--that you are making the statement to a third party. If it was a personal conversion (he & you only) how could it possibly be slander? Without any one else to hear it, it is hear say anyway. All you would have to do is deny that you ever said it. Done!

This can't possibly hold water, can it? The question that someone in this position might ask themselves is: What could be accomplished from putting one's self in that position? If this person is what you say, one might conclude that he is already aware of it and is not concerned with the opinion of others. If he isn't what you say, obviously the person in question would have the right to be bothered by the assessment. This and other replies to this seem to be based on the account as it has been presented, and as mentioned in other posts, might be dependent upon the lack of a third party present...

My question is.....why are you asking this question? I have the same question. Since you stated that he is already involved in a Lawsuit by SC against him already, were you saying he is a pirate or perceived to be a pirate because of that, or was there more to your conversation with this KJ? Did he have an eyepatch or wood leg? Did he have a little captain in 'em? Were you at Disneyworld? Did he, at any time during your discussion, say "Arrrrrrrrrr?"
All three would go a long way in your defense, especially if you are going to settle this slander suit in a TV courtroom.

Cue, as I'm sure you're aware, the only legal advice I can give to anyone who is not my client is to consult with a licensed attorney. It is a good practice to remind people to consult with their attorneys when evaluating their exposure, rather than relying on general legal information. Whether they do or not is up to them, but I don't want it to be because they think I told them everything they need to know.

I believe the situation was that Karaoke Lurker was approached by the people in question to purchase some karaoke utility software that they had written (At a rather hefty price I might add). Karaoke Lurker turned them down because they had indicated to him that they never pay for their music, they just download it for free and Karaoke Lurker didn't want to support pirates. this was all in a private conversation between Karaoke Lurker and the others in question. I don't know the identity of the people Karaoke Lurker was talking to I just know that he was approached and the basic content of the conversation.

I thought that I read somewhere that Sound Choice's estimates are that 90% of all KJs are pirates. Original poster has a 9 out of 10 chances of being right. Those are some pretty good odds.
