I think the court screwed up though. The gross award was over 1.5 million and the actual gross revenue from the use of the songs was less than 10k. That does seem a little over much to me.
I would have argued that the plaintif Zomba music didn't hold the copyright as they did not author the music nor was it a work for hire. Transfer of copyright would exceed the authority of copyright granted under the first amendment so there could be no valid law. That probably would have gotten some laughs from the bench.
