I think the court screwed up though.  The gross award was over 1.5 million and the actual gross revenue from the use of the songs was less than 10k.  That does seem a little over much to me.

I would have argued that  the plaintif Zomba music didn't hold the copyright as they did not author the music nor was it a work for hire.  Transfer of copyright would exceed the authority of copyright granted under the first amendment so there could be no valid law.  That probably would have gotten some laughs from the bench.

Sure,  You can argue that copyright law is "censorship" and use the tension that exists between such law and hone in on certain first amendment rights

I wasn't thinking of the cencorship angle.  I was thinking more that copyright is expressly granted for a limited time to the author or inventor as stated in artical 8, but there is no mechanism in the constitution for transfer of that copyright.  Legal action would have to be brought by the copyright holder, the song writer in this case.

These guys should be hung But I have searched and googled for hours trying to find the judgement outcome for copyright or ascap pertaining to karaoke Its just like Bull & Bear in ny It never was broadcast what the outcome was I even emailed the reporter and didnt get a reply.

Chances are we will never see the outcome of this or KAPA would post it.
